Footnote #1: The title of Marchese del Fiddien was conferred by Grand Master De Rohan upon Salvatore Mallia Tabone, by a patent of the 15th October 1785. The terms of the patent are identical with the original patents of  Barone di Buleben, (Azzopardi), Marchese di San Giorgio, (Barbaro) and Conte di Beberrua (Gatt), in the sense that it contains no description of children or descendants, but only the name of the person ennobled. The patent granted to Mallia Tabone reads thus: Tibi donamus ac te Marchionis hujusmodi titulo decoramus See:- Correspondence and Report of the Commission appointed to enquire into the claims and grievances of the Maltese Nobility, May 1878, presented to both Houses of Parliament by Command of Her Majesty (C.-2033.) Footnote #2: The title of Marchese del Fiddien is the eighth (8th) in line of the new families that were ennobled by Grand Master Emmanuel de Rohan de Polduc (1775-97). This Grand Master granted a total of 17 new titles thereby making a substantial incursion into the established nobility of Malta, namely: (i) Marchese di Sciorp il-Hagin granted to Claudio Muscati Xiberras (8 March 1776 - extinct), (ii) Barone della Marsa granted to Gio Francesco Dorell Falzon on the 10 March 1776 in the following terms: - Tibi Magnifico ac Nobili D. Joanni Francisco Dorel Falzon tuisque descentibus masculis tribuimus concedimus et donamus, hujusmodique Baronis titulo insignimus, ac Baronem dicti feudi della Marsa constituimus, et ita nominari posse et debere.... Previous Grand Masters were more discriminate in their generosity. In fact Grand Masters Jean-Paul de Lascaris de Castellar (1560-1657), Antonio Manokl de Vilhena (1663-1736), Ramsn Despuig y Martinez de Marcilla (1670-1741) and Manuel Pinto de Fonseca (1681-1773) only conferred three titles each, Grand Master Ramsn Perellss y Rocafull (1637-1720) two, whilst Grand Master Francisco Ximenes de Texada (1703-75) is the least generous as he only conferred one title. No other titles were conferred but the same Grand Masters (e.g. Despuig and Rohan) may have made amendments to previous grants, others (e.g. Lascaris, Vilhena and Zondadari) going as far as “recognizing” directly or indirectly other titles which did not originate under the Order”s government of the Maltese Islands.

Footnote #3: The 1878 Commissioners remarked that the numerous grants of titles made by Grand Master Rohan may be classed under three different heads”, namely those expressly providing for the perpetuity of the title specifically include the children and descendents in infinitum of the person first ennobled, those which only designated the grantees' names without proceeding further and lastly those which contain a restrictive clause. Footnote #4: In regard to the title of Marchese del Fiddien, the 1878 Commissioners observed: This grant was also taken by the Grand Master to be personal to the grantee, for after the grant, the Marchese Salvatore presented a petition praying that, in consideration of the merits of his ancestors, the grant might be made to extend to his legitimate and natural male descendants successively, and in default of male issue to his female descendants: and by a rescript of the 15th June 1793, the request was only partly complied with, in the following terms: Fiat pro primogenitis maribus tantum. Footnote #5: The circumstance of the 1793 extension in favour of Mallia Tabone particularly the Grand Masters limited assent in favour of primogenitus tantum excludes the possibility of a female holding the title, even if such female happens to be the primogenial descendant of the grantee.

 

Footnote #6: In the case of the title of Marchese del Fiddien as extended in 1793, it is plain that the Grand Master specifically limited the grant to the maribus. Unlike for example Marchese di Gnien is-Sultan where the Grand Master made special provision for circumstances by a female in the event of the exhaustion of all male-to-male descendants, or for example, Barone della Grua where the Grand Master did not exclude the possibility of succession by a male in the primogenial line, albeit such line be through a female, the limited assent by the Grand Master in 1793 demonstrates that the Grand Master only contemplated the agnatio of the person who applied for the extension. This rule was also explained by the same Commissioners thus: “With reference to that question, we beg to submit that it is a settled point of jurisprudence that the appellation of male descendants includes not only the sons issuing from the male line (masculi ex masculis), but also those issuing from the female line (masculi ex foeminis), when, however, some other expression occurs in the deed of grant which controls the meaning of that term, as for instance when the grantor limits his grant to such among his male descendants as should belong to the male line (descendentes masculi ex linea masculina);, or when he employs other words which clearly show that he contemplated the grantee”s agnatio, in such case, the effect of the disposition is limited to the male line, and on the failure of males issuing from that line the grant becomes extinct, the male issue of daughters not being called into succession.” (See:- Correspondence and Report of the Commission appointed to enquire into the claims and grievances of the Maltese Nobility, May 1878, presented to both Houses of Parliament by Command of Her Majesty (C.-2033.) Footnote #7: The limited assent to the 1793 rescript also prevents any interpretation allowing a male descending in a female line from succeeding in the title granted to Mallia Tabone. This is said in the light of the settled principle explained by the 1878 Commissioners that any interpretation of Magistral assent to a rescript must be restrictive and that wide interpretations are only allowed in grants made motu proprio. This maxim is explained by the Commissioners thus:  The claimant lastly contends that the diploma and the rescript must be extensively construed; for although it is a legal maxim, Privilegia sunt stricte interpretanda, the privileges, however, granted by a sovereign authority, and which do not act to the prejudice of third parties, are susceptible of a wide and liberal interpretation. Although this is admitted by the common opinion of civilians, yet that principle holds good with regard to those privileges which are granted by the sovereign”s mere motion (moto proprio) and not at the request of the party concerned (Jasonii Comment. Quoted by Altograd. Consilia Con. 71, No. 9, 10, 11, and by many other legal writers). Now as a general rule, patents of nobility in Malta were granted by the Grand Masters at the request of the grantee, and it was moreover upon an application by Barone Azzopardi that the rescript of 1778 was issued. It is likewise a settled opinion that, when the patent of creation does not contain the expression motu proprio, the grant is taken to have been made at the request of the party concerned. Footnote #8: The grantor of this title, the Grand Master Rohan also amended the rules for selection of Jurats (taken to be the basis of the rule of precedence amongst the Maltese nobility) in 1795, the first rule being that enacted by Grand Master Despuig. These latter rules were considered by the 1878 Commissioners as the first and only two legislation regulating the Maltese Nobility as a body during the Government of the Grand Masters in Malta. (Para. 104) -  That is to say a very, very long time after 1090 which is the much vaunted date when Roger the Norman is supposed to have organised Maltese society into nobles, burghers and rustics. In both the Despuig and Rohan rules, emphasis is made on the male-to-male descent of persons qualifying for appointment, namely the discendente per linea mascolina thereby reinforcing the restrictive interpretation indicated above in regard to the title in question. Footnote #1: The aforesaid Salvatore Caruana Dingli is noted by some published sources (See for example, Gauci Charles The Genealogy and Heraldry of the Noble Families of Malta, Gulf Publishing, 1981 and Gauci Charles The Genealogy and Heraldry of the Noble Families of Malta, Volume Two, PEG Publications, 1992) as having succeeded the title. Although, as appears from the genealogical chart Caruana Dingli was indeed the then seniormost male descendant descending in the primogenial line of the original grantee, such “succession” does not appear to be founded on the 1793 rescript because Caruana Dingli could only claim through a female. . See footnotes above and below.

 

Footnote #2: Some other descendants (also descending in the same female line as Caruana Dingli) have also been noted by the same sources as having “succeeded” the title. In addition to the limitations of the 1793 rescript which prevent transmission through a female, it is to be remarked that these other “successors” are moreover only descended in a junior sub-line.

 

Footnote #3: According to the genealogical chart all male to male descent of the 2nd and 3rd Marchesi del Fiddien is extinct. However, it appears according to the same chart that there is living a male-to-male line descending from Guillermo Mallia Tabone, son of the 1st Marchese. In this case, it follows that in terms of the 1793 rescript, the seniormost male from Guillermo Mallia Tabone”s line succeeds the title and that this title becomes extinct upon the determination of the last male to male issue of the aforesaid line of Guillermo Mallia Tabone.
