Footnote: The title of Marchese di Ghain Kajet was granted by Grand Master Rohan on the 4 June 1796. It is the last of the titles to have ever been granted by the Grand Masters. Succession is by primogeniture, as results from the grant, which provides Praedictum Marchionis de ghain Kajet titulum, tibi Magnifico ac Nobili Hyeronimo Delicata, tuisque descendentibus primogenitis legitimis et naturalibus tribuimus concedimus, et donamus. Footnote #1: Some published sources declare this title to be extinct or in abeyance (e.g. see Montalto, J. The Nobles of Malta, MidSea Books, 1980, p.367). This view is probably inspired by the fact that the male-to-male issue of the grantee Gerolamo Delicata was extinguished upon the death of the 3rd Marchese .

On the other hand, however, this view is contradicted by the preferred argument that this title may be transmitted in the female line according to the general rules of primogeniture, which allow artificial agnation whenever this has either not been expressly excluded, or wherever there do not exist circumstances which exclude it . In this case, the title would have been succeeded by Luigi Manduca Gauci (3.1.1.). See also http://www.maltagenealogy.com/SME/ghajnkajet.html. and http://www.maltagenealogy.com/SME/grua1.html . However, even if the remainder allows a male descended in the female line, it is unclear whether in this case, the remainder tuisque descendentibus primogenitis legitimis et naturalibus tribuimus concedimus, et donamus allows a female to hold the title,particularly because the formula does not continue making provision for enjoyment by females, as witnessd in similar titles granted by the Grand Masters whenever these refer to a primogenial remainder.

A third argument could be that upon the death of the 3rd Marchese , the title should have been construed in favour of the next seniormost male to male descendant of the original grantee, in this case the male-to-male descendants of the first Marchese, namely Temistole Delicata (see above - 3.1.1) who was alive at the time of death of the 3rd Marchese failing whom Temistoles son Giuseppe Delicata (see above - 3.1.1.1. ). This last argument is academic in view of the fact that it now appears that all of Gerolamo Delicata’s male-to-male descendants are extinct.

 

Footnote #2: The Formosa de Fremaux family has long been associated with the title Conte di Santa Sofia, However, published sources do not indicate its origin except that it is said to be French.
