Footnote#1: The title of Conte Preziosi appears to have been conferred on Giuseppe Preziosi by Victor-Amadeus, King of Sicily, Duke of Savoy &c, and Perpetual Vicar of the Empire, by a patent given at Rivoli on the 19th October 1718. The original patent of creation is stated to have been burnt up during the government of the French Republic. See:- Correspondence and Report of the Commission appointed to enquire into the claims and grievances of the Maltese Nobility, May 1878, presented to both Houses of Parliament by Command of Her Majesty (C.-2033.) (See Report Paras. 173-175. Supplemental Report Part II). The remainder of this title is described by the Commissioners not in the part relative to the Preziosi grant but elsewhere in the part relative to the title of Marchese Testaferrata as follows: King Victor Amadeus himself in the grant of the title of Conte, conferred upon Giuseppe Preziosi, on the 19th October 1718, wishing to exclude from the succession of the grantee’s female issue, ordered that the title was to hold to the grantee and his legitimate and natural male descendants, in lawful wedlock begotten, whether born or to be born. (See Report Paras. 122-172).  Consequently it follows that female issue is excluded from this title.

 

Footnote#2: At Maltese Law the title conferred on Preziosi is only a foreign title and, as such, it can be considered for the purposes of precedence only if registration or Magistral recognition has been achieved. in accordance with the rules of 1739 and 1795 as enacted by Grand Masters Despuig and Rohan.  In this case, the grant was regularly registered in a record of the Cancelleria, in consequence of a rescript of the Grand Master, bearing date the 20th June 1720, that is to say many years before registration became compulsory. It is unclear why Preziosi took this initiative to register this title, particularly when the 1878 Commission held that a direct recognition by the Grand Master was sufficient in the cases of Djar il-Bniet and Buqana (1725 recognition), Castel Cicciano (1725 recognition), San Vincenzo Ferreri (1725 recognition) and Conte enjoyed by the family Wzzini Paleologo (1722 recognition) because these latter titles were deemed existent prior to the 1739 rules

 

Footnote#3: It appears that in the copy of the patent registered there is recorded the following expression::-We command that it should be registered in our Secretairerie of State. In 1878, the Maltese Commissioners observed that in the Maltese registration, there is no allusion therein to the place in which it was enrolled agreeably to the King’s (i.e. the grantor’s) commands. Footnote#4: Notwithstanding that the 1878 Commissioners did not have sight of the original and nor was there any proof of whether the title was in fact registered in accordance with the grantor's command, it appears that a question arose during the course of the 1878 inquiry whether the title belongs to the first-born son of the family only, or is to be taken to extend simultaneously to all the male descendents of the original grantee Giuseppe Preziosi. In fact, in 1878 several gentlemen claimed that the grant allowed for multiple succession. Footnote#5: The 1878 Commissioners stated that In order to determine the question whether the title belongs to the first-born son of the family only, or is to be taken to extend simultaneously to all the male descendents of Giuseppe Preziosi, first count, as it is assumed by several gentlemen who claim it, most of the remarks made by us with reference to the preceding title of marquis (i.e. Marquis Testaferrata), may be properly applied to the present case. See:- Correspondence and Report of the Commission appointed to enquire into the claims and grievances of the Maltese Nobility, May 1878, presented to both Houses of Parliament by Command of Her Majesty (C.-2033.) (See Report Paras. 173-175. Supplemental Report Part II). It appears that the Commissioners were here referring in particular to their earlier statements, where they said: (a) We have entered into all these particulars, because some of the gentlemen who claim the right of simultaneously enjoying the title we are considering (i.e. Marquis Testaferrata), have based several of their arguments on the hypothesis that the extension of that title is to be regulated by certain principles of feudal law, which at the time of the grant obtained in Germany, Lombardy, Savoy, and in other parts of Italy, and by the so-termed custom of the Longobards and (b) If by that grant (i.e. Marquis Testaferrata), it was intended to raise Mario to the nobility of Savoy, we fully concur in the opinion that it is inheritable by all the grantee's contemporary descendants. In Germany, in Lombardy and in other parts of Italy, including the Duchy of Savoy, a custom since a distant period obtained under which the titles of nobility that are annexed to fiefs (which in those countries are divisible), as well as those which are purely nominal, descend after the decease of a count or marquis to all his sons, who all assume the title of count or marquis, as the case may be. But if the succession to the grant is to be regulated by the feudal law which was in force in Sicily, considering that the title was created by a King of Sicily and registered in the Office of the Privileges of the Kingdom of Sicily, the consequence is widely different. In Sicily, as a general rule, (admitting of course to some exceptions) fiefs are not divisible, and the joint possession of titles by more than one person is unknown in that country. Footnote#6. The Commissioners were requested to reach a decision and in their Supplemental Report, the Commissioners then decided as follows: We beg respectfully to refer to our remarks on the claim to the title of Marchese conferred by the said King Victor-Amadeus, in 1717, on Mario Testaferrata (#166 et seq.). It will be seen that the grant by Victor-Amadeus to Mario Testaferrata, was made under the law respecting the titles of the Sicilian nobility, and that it is consequently descendible to the firstborn son only, according to the order of succession prescribed by the ius feudale francorum. Applying those remarks to the present case, it is obvious that the title of Conte granted to Giuseppe Preziosi cannot be enjoyed but by Amadeo Preziosi, whose name has been included in our list of Titolati in our former Report, and that the other gentlemen who have asserted a right to this title have not succeeded in making out their claims. Supplemental Report Part II).  In this way, the title was deemed in 1878 as descendible to the firstborn son only, according to the order of succession prescribed by the ius feudale francorum.

Footnote#7. Notwithstanding the 1878 Commissioners conclusions (footnote 6), and based on what was first stated by the Commissioners themselves (footnote 1), it is clear that (a) the title originated in Rivoli which formed part of the Kingdom of Savoy, not the Kingdom of Sicily thereby meaning that the title was subject to the ius feudale longobardum and (b) that in any event and in this case female succession is by the 1878 Commissioners described as having been excluded thereby proving that the title to Preziosi was subject to the ius feudale longobardum or, at least an altered version of the ius feudale francorum.

 

Footnote#8. Some published sources list Gio Francesco Preziosi as the 2nd Conte (in terms of the ius feudale francorum). These sources appear to overlook the fact that Gio. Francesco had an elder brother. Thus the said Gio Francesco is only the 3rd Conte (in terms of the ius feudale francorum) or, more likely, one of the 2nd generation of Conti Preziosi in terms of the ius feudale longobardum.
